However, the evidence also indicated that these conditions were capable of treatment and that improvement was ongoing. Crucially, the Deputy President found that Mr Sibai had a willingness to learn and that his perceived inability to learn English stemmed from a choice not to study, rather than an enduring incapacity. Therefore, the Deputy President concluded that Mr Sibai did not satisfy the requirements of section 21(3) of the Act and was not exempt from sitting the citizenship test. The delegate's decision to refuse the application was affirmed.
