CaseChat Overview and Summary
This matter concerned an application for a Skilled (Provisional) (Class VC) visa, subclass 487 (Skilled – Regional Sponsored). The applicant's business owner sponsor and claims of close personal ties were considered alongside allegations of bogus documents, false work references, conflicting work and study patterns, and inconsistent evidence. The review was conducted by Catherine Carney-Orsborn.
The central legal issue before the Tribunal was whether the applicant met Public Interest Criterion (PIC) 4020, as required by clause 487.228 of the Migration Regulations 1994. This criterion broadly requires that the applicant has not provided a bogus document or false or misleading information in relation to the visa application or a previous visa held within 12 months, and that the applicant and their family unit have not had a visa refused due to a failure to satisfy PIC 4020(1) within specified periods, subject to certain exceptions for applicants under 18. The Tribunal also considered the identity requirements under PIC 4020(2A) and (2B).
The Tribunal reasoned that the applicant had not met the requirements of PIC 4020(1). It noted that the definition of a "bogus document" under section 5(1) of the Migration Act 1958 does not require the document to be relevant to a criterion for the grant of the visa, unlike the definition of "information that is false or misleading in a material particular" under PIC 4020(5). The Tribunal also highlighted that PIC 4020(1) applies regardless of whether the Minister became aware of the issue through information provided by the applicant, and whether the document or information was provided knowingly or unwittingly. The Tribunal found no evidence that the applicant met the criteria for any other visa subclass within the class sought.
Consequently, the Tribunal affirmed the decision not to grant the applicant the Skilled (Provisional) (Class VC) visas.
