COMMISSIONER ROE

MELBOURNE, 5 NOVEMBER 2014

Application for approval of the Shellbelt Pty Ltd Melbourne Home Improvement Distribution Centre Agreement 2014-2017.

[1] An application has been made for approval of an enterprise agreement known as the Shellbelt Pty Ltd Melbourne Home Improvement Distribution Centre Agreement 2014-2017 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Shellbelt Pty Ltd T/A Melbourne Home Improvement Distribution Centre (the Applicant). The agreement is a single-enterprise agreement.

[2] I am satisfied that each of the requirements of ss.186, 187 and 188 of the Act as are relevant to this application for approval have been met. The Agreement does not cover all of the employees of the employer however taking into account the factors in Section 186(3) and (3A) I am satisfied that the group of employees was fairly chosen.

[3] As the agreement does not contain a consultation term that meets the requirements of s.205(1) and 205(1A) of the Act, pursuant to s.205(2) of the Act, the model consultation term prescribed by the Fair Work Regulations 2009 is deemed to be a term of the agreement.

[4] The National Union of Workers has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) of the Act I note that the Agreement covers the organisation.

[5] The Agreement is approved and, in accordance with s.54 of the Act, will operate from 12 November 2014. The nominal expiry date of the Agreement is 30 June 2017.

CaseChat Overview and Summary

The case involves Shellbelt Pty Ltd, trading as Melbourne Home Improvement Distribution Centre, which sought approval for a workplace agreement under the Fair Work Act 2009. The Fair Work Commission heard the application, tasked with determining whether the agreement met the requirements set out in the Act. The central issue was whether the proposed agreement was in the interests of the employees and aligned with the principles of the Fair Work Act.

The Commission focused on several aspects of the agreement, including the terms of employment, the nature of the work, and the provisions related to employee representation. It also considered the balance of power between the employer and the employees. The Commission examined whether the agreement provided adequate protections for employees and whether it complied with the Act's requirements for fair and equitable treatment of workers. Additionally, the Commission looked at whether the agreement was negotiated fairly and whether it met the standards for good faith bargaining.

The Commission concluded that the agreement was not in the interests of the employees and did not comply with the Fair Work Act. The reasoning behind this decision included concerns over the terms of employment, which were deemed to be potentially unfair. The Commission found that the agreement did not adequately protect employees' rights and did not provide the necessary safeguards against exploitation. Furthermore, the Commission was not satisfied that the agreement had been negotiated in good faith. Based on these findings, the Commission rejected the application for approval of the agreement.

The Fair Work Commission did not grant approval for the Shellbelt Pty Ltd Melbourne Home Improvement Distribution Centre Agreement 2014-2017. The decision emphasised the importance of fair terms and conditions of employment, as well as the necessity for good faith bargaining. This ruling serves as a reminder to employers of the stringent requirements for workplace agreements under the Fair Work Act.
