SHARMA v Minister for Immigration

Sharma (the applicant) sought judicial review of a decision by the Minister for Immigration (the respondent) to refuse to grant a visa. The applicant had applied for a Protection visa. The Minister's delegate had refused the application, and this decision was affirmed by the Administrative Appeals Tribunal (AAT). The applicant then sought review of the AAT's decision in the Federal Circuit Court.

The primary legal issue before the Court was whether the AAT had erred in law in its assessment of the applicant's claims for protection. Specifically, the Court was required to consider whether the AAT had failed to adequately consider the evidence presented by the applicant regarding the risk of persecution in their country of origin, and whether the AAT had applied the correct legal test in determining whether the applicant met the criteria for a Protection visa.

Judge Lindsay found that the AAT had made a jurisdictional error. The Court reasoned that the AAT had failed to properly engage with the applicant's evidence concerning the specific risks they faced, particularly in relation to their membership of a particular social group. The AAT's decision was found to be based on an erroneous understanding of the relevant legal principles governing the assessment of protection claims, leading to an unfair and inadequate review of the applicant's case.

The Court ordered that the decision of the Administrative Appeals Tribunal be set aside and remitted to the Tribunal for redetermination according to law.
