Sharma's Kitchen Pty Ltd (Migration)

Sharma's Kitchen Pty Ltd sought judicial review of a decision made by the delegate of the Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs. The delegate had refused to approve Sharma's Kitchen's nomination of a position for a skilled migration visa, finding that the nominated occupation did not meet the requirements of the relevant legislative instrument. The matter came before Dougall J in the Federal Court of Australia.

Dougall J reasoned that while Sharma's Kitchen engaged in mass production, the evidence also indicated the production of specialised items for religious and cultural events that could not be machine-made. The Court considered the scale of operations, the potential for sales and export, and the nominee's role in training other workers. By comparing the position description with the ANZSCO listing and considering the overall context of the business and the nominee's contribution, the Court found that the delegate had erred in failing to properly assess the genuineness of the position and its alignment with the relevant criteria.

The Court ordered that the decision under review be set aside.
