Sharma (Migration)

The Administrative Appeals Tribunal considered an application for a Subclass 500 (Student) visa. The applicant, Ms. Sharma, sought review of a decision to refuse her visa.

The primary legal issue before the Tribunal was whether Ms. Sharma met the genuine temporary entrant (GTE) requirement for the visa. This involved assessing whether she genuinely intended to stay in Australia temporarily for the purpose of study and would depart Australia at the end of her proposed stay.

The Tribunal found that while there were some isolated and minor gaps in Ms. Sharma's enrolment history, her current attendance and progression in her studies, coupled with strong financial and family ties to her home country, and the perceived value of the course to her future employment prospects, indicated that she met the GTE criterion. The Tribunal remitted the application for reconsideration with a direction that the applicant meets the GTE criterion as set out in cl 500.212 of Schedule 2 to the Regulations.
