Shamas (Migration)

The Administrative Appeals Tribunal considered the application of Mr Shamas for a Student (Temporary) (Class TU) visa, subclass 500. The dispute concerned whether Mr Shamas had provided sufficient evidence of his financial capacity to meet the criteria for the grant of this visa, which was for a Master of Commerce course in Leadership and Management.

The primary legal issue before the Tribunal was to determine if the applicant had satisfied the financial capacity requirements as stipulated by the relevant regulations for a subclass 500 student visa.

The Tribunal, having reviewed the evidence presented, found that the applicant did meet the necessary criteria. Consequently, the Tribunal remitted the decisions under review with a direction that the applicant be considered to meet the criteria for the grant of the visa. The decision was made by Member Tim Connellan on 18 December 2018.
