CaseChat Overview and Summary
The legal issues before the Commission included whether the enterprise agreement contained all the minimum terms and conditions as prescribed by the Fair Work Act, and if the agreement had been genuinely negotiated. Additionally, the Commission had to consider whether the proposed agreement met the "better off overall test" and whether the agreement was procedurally fair and reasonable in all its aspects. The Commission also needed to determine if any terms of the agreement were contrary to public policy.
The Fair Work Commission found that the proposed enterprise agreement contained all the required minimum terms and conditions and was genuinely negotiated. The Commission determined that the agreement met the better off overall test, meaning that the employees would be no worse off and at least some would be better off financially. The Commission also found that the agreement did not contravene any public policy and was procedurally fair and reasonable. Consequently, the Commission approved the Seven Network (Operations) Limited Productions Enterprise Agreement 2019.
