Selena and Montez

In the matter of Selena and Montez, heard before Rees J, the dispute concerned applications for interim spousal maintenance and property settlement. The wife sought orders for both interim spousal maintenance and a partial property settlement, while the husband was ordered to make payments and meet mortgage obligations.

The court was required to determine the appropriate quantum of interim spousal maintenance, the amount of a partial property settlement, and the husband's obligations regarding mortgage payments and indemnification of the wife pending further orders. The court also reserved the costs of the application.

Rees J ordered the husband to pay the wife $500 per week by way of interim spousal maintenance, commencing on 18 April 2016. Furthermore, the husband was directed to pay the wife $135,000 by way of partial property settlement on or before 1 August 2016. The husband was also ordered to continue making all mortgage and loan repayments to ING Bank in respect of the property at B Street, Suburb C, and to indemnify the wife for these payments until further order.
