This case concerned an application for an Other Family (Migrant) (Class BO) Carer visa (subclass 116). The applicant, Ms Meow Choo Liew, sought to migrate to Australia to care for her sister, Ms Miow Chin Liew, who required care due to multiple medical issues. The sponsorship for the visa application was provided by another sister, Mrs Siew Lin See, an Australian citizen, who was unable to care for Ms Miow herself due to her own work-related injuries and medical conditions. The Administrative Appeals Tribunal was required to determine whether the sponsorship requirements were met at the time of the visa application.

The central legal issue before the Tribunal was whether the sponsorship requirements stipulated in clauses 116.211 and 116.212 of Schedule 2 to the Migration Regulations 1994 were satisfied. Clause 116.211 requires the visa applicant to claim to be a carer of an Australian relative, while clause 116.212 mandates that the applicant be sponsored by that Australian relative, or their spouse or de facto partner. The Tribunal considered the definitions of "relative" and the conditions for sponsorship by a spouse or de facto partner, including cohabitation and citizenship or residency status.

The Tribunal found that while Ms Meow claimed to be a carer for her sister Ms Miow, who was an Australian resident, the sponsorship was provided by Mrs See, not Ms Miow herself or Ms Miow's spouse. Mrs See, as an Australian citizen, was eligible to be a sponsor. However, the regulations required the sponsor to be the Australian relative needing care, or their spouse or de facto partner. Mrs See was not the relative needing care, nor was she the spouse or de facto partner of the relative needing care. Therefore, the sponsorship requirements were not met.

Consequently, the Tribunal affirmed the decision not to grant the Other Family (Migrant) (Class BO) visas to Ms Meow Choo Liew and any secondary applicants.
