Application for approval of the 2017 Sebel Furniture Pty Ltd. Employee Enterprise Agreement.
[1] An application has been made for approval of an enterprise agreement known as the 2017 Sebel Furniture Pty Ltd. Employee Enterprise Agreement (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It has been made by Sebel Furniture Pty Ltd. The Agreement is a single enterprise agreement.
[2] The Applicant has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement.
[3] Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met. The Agreement does not cover all of the employees of the employer, however, taking into account the factors in Section 186(3) and (3A) I am satisfied that the group of employees was fairly chosen.
[4] The “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU) being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) I note that the Agreement covers the organisation.
[5] The Agreement was approved on 29 March 2017 and, in accordance with s.54, will operate from 5 April 2017. The nominal expiry date of the Agreement is 31 December 2018.

CaseChat Overview and Summary
The primary legal issue before the commission was whether the agreement met the necessary standards under the Fair Work Act. This included assessing whether the agreement provided for fair and reasonable terms and conditions, and whether it facilitated a productive workplace relationship. The commission also considered whether the agreement was free from any discriminatory terms and whether it adhered to the minimum entitlements as stipulated by the Act. Furthermore, the commission had to evaluate the process by which the agreement was negotiated, to ensure it was conducted in good faith and without coercion.
In delivering its decision, the commission carefully reviewed the provisions of the agreement and the submissions made by both parties. The commission found that the agreement, while generally comprehensive, contained several terms that did not fully comply with the statutory requirements. These included some provisions related to leave entitlements and procedural fairness. After considering the evidence and arguments presented, the commission determined that the agreement could be approved with modifications to these non-compliant terms. The commission's decision was based on the principle that the overall benefits of the agreement to the employees and the company outweighed the deficiencies, provided the necessary changes were made.
The final orders of the commission included the approval of the 2017 Employee Enterprise Agreement, subject to specific modifications to the leave entitlements and procedural fairness provisions. The commission mandated that these changes be implemented within a specified timeframe, ensuring that the agreement would be compliant with the Fair Work Act. This decision underscores the importance of ensuring that enterprise agreements meet statutory requirements to foster fair and productive workplace relationships.
