CaseChat Overview and Summary

In the matter of Seaton and Fogarty, Carew J of the Family Court of Australia considered a dispute concerning the parental responsibility and living arrangements for a child, X, born in 2011. The proceedings involved the child's mother and father, Mr Fogarty, with the paternal grandfather, Mr B Fogarty, also playing a significant role in the child's care and the court's considerations.

The court was required to determine the primary caregiver for the child, including sole parental responsibility for major long-term issues, and where the child would live. Additionally, the court had to address immediate arrangements for the child's care, establish conditions for the father's re-engagement with the child, and set out a framework for the mother's future contact with the child. The court also considered the need for professional intervention to facilitate the child's transition and address parental behaviours.

Carew J ordered that the father, Mr Fogarty, have sole parental responsibility for major long-term issues and that the child live with him, subject to several conditions. The child was to immediately leave the court with the paternal grandfather and remain in his care. The father was restrained from approaching the child until specific expert sessions occurred, and the mother was restrained from removing the child from Child Dispute Services. The father was required to vacate his current residence with the paternal grandfather and not return until he and the child had met separately and then together with a nominated expert, to explain the orders, assist the father in approaching the child, and facilitate initial encounters. The father was also ordered to engage in counselling with a child psychologist. The mother was granted liberty to attend upon the same expert at her own cost, with her sessions to occur after those involving the father and child. The mother's future time with the child was to commence with supervised visits, progressing to unsupervised time thereafter, with specific arrangements for changeovers and communication of contact details. The independent children's lawyer was discharged.
