CaseChat Overview and Summary

The Fair Work Commission heard an application by Seacom Technical Services Pty Ltd as Trustee for the Secom Technical Services Unit Trust T/A Secom Technical Services for approval of the Secom Technical Services Pty Ltd Single Enterprise Agreement 2017. The applicant sought approval of the agreement under section 233 of the Fair Work Act 2009. The dispute involved the terms and conditions of employment for the workers within the enterprise, and the role of the Fair Work Commission in approving such agreements.

The primary legal issue before the Commission was whether the agreement met the statutory requirements for approval under the Fair Work Act. Specifically, the Commission needed to determine whether the agreement provided for minimum terms of employment, was free from prohibited content, and was in the public interest. Additionally, the Commission assessed whether the agreement had been made in accordance with the processes prescribed by the Act, including whether it had been subjected to the appropriate bargaining process.

The Fair Work Commission found that the agreement met the necessary statutory requirements for approval. The Commission noted that the agreement contained provisions for minimum terms of employment and did not include any prohibited content. The Commission was satisfied that the agreement had been made in accordance with the processes prescribed by the Act, including the requirement for good faith bargaining. Furthermore, the Commission considered that the agreement was in the public interest, as it provided for fair and reasonable terms of employment for the workers covered by the agreement. Based on these findings, the Commission approved the agreement.

The Fair Work Commission approved the Secom Technical Services Pty Ltd Single Enterprise Agreement 2017, effective from the date of the Commission's decision. The approval is subject to the agreement being registered with the Fair Work Commission Registry within the timeframe prescribed by the Fair Work Act.
