CaseChat Overview and Summary

This matter concerned a claim for compensation by the applicant, Mr Saunders, against his employer, K & S Freighters Pty Ltd, following an injury sustained when alighting from a truck. The dispute centred on whether a fall experienced by the applicant aggravated or exacerbated a pre-existing degenerative hip condition. The case was heard by Senior Member B J Illingworth and Member Doctor L Stephan.

The legal issues before the Tribunal were to determine the nature and extent of the applicant's injuries following the fall, and crucially, whether the fall caused, aggravated, or exacerbated his pre-existing osteoarthritis of the right hip. The Tribunal was required to consider the medical evidence presented, including reports from various medical practitioners, and the applicant's own account of his activities, both before and after the incident, to ascertain the causal link between the fall and his ongoing hip condition.

The Tribunal found that the applicant suffered from pre-existing osteoarthritis and other degenerative changes in his right hip, which may have been present for a significant period. While the applicant did fall and sustained trochanteric bursitis, the Tribunal preferred the expert evidence of AP Steadman and Dr Menz. These experts opined that the fall did not cause, aggravate, or exacerbate the applicant's pre-existing osteoarthritis, concluding that any impact was temporary and akin to a soft tissue injury. The Tribunal was satisfied that the observed changes in the applicant's hip condition after the fall represented the natural progression of his degenerative condition, rather than an injury caused or worsened by the fall. The Tribunal's conclusion was that the applicant's ongoing hip pain was due to the natural progression of his osteoarthritis, unaffected by the fall.
