The Administrative Appeals Tribunal considered an application for a Subclass 602 Medical Treatment visa made on behalf of Aathmika, a minor, by her father, Mr. Nair. This involved assessing her compliance with previous visa conditions, her intention to comply with future visa conditions, and any other relevant matters. The Tribunal also had to consider whether Aathmika was medically unfit to depart Australia, a condition that would exempt her from the temporary stay requirement, but found she did not meet this exemption.

In its reasoning, the Tribunal found Mr. Nair to be a credible witness, whose evidence was supported by departmental records. While acknowledging concerns arising from the parents' immigration history, the Tribunal concluded that a closer examination revealed periods of substantial time spent in India since 2008, and any periods spent in Australia after visa expiry were short and in specific circumstances without other breaches of visa conditions. The Tribunal was satisfied that the family would abide by visa conditions. Despite the ongoing medical treatment being described as "long-term" and the applicant's father being unable to clearly state the exact duration sought, the Tribunal was satisfied, based on medical evidence, that treatment was continuing and might extend into the foreseeable future.

Consequently, the Tribunal found that clause 602.215 was met. The matter was remitted to the Minister for reconsideration of the remaining criteria for a Subclass 602 visa.
