Sand and Sand

This matter concerned a property settlement, maintenance and parenting orders in relation to a former couple and their young daughter, [X]. The husband, Mr Sand, and the wife, Ms Sand, married in 2003 and separated in 2009. They have one child, [X], born in 2009. The wife's application for a property settlement and spouse maintenance was dismissed by the husband. The husband proposed orders that each party retain all items of real property and personalty presently in their possession. The wife proposed orders that the husband pay to her the sum of $125,000.00 by way of property settlement and pay spousal maintenance of $500.00 per week for a period of five years. The wife also sought an order for the husband to deliver up his passport and for an airport watch order to be put in place. The court found that the wife had a need for a property settlement of $120,000.00 and that such amount be paid by instalments of $750.00 per fortnight. The court dismissed the wife's application for spouse maintenance and declined to make an order for the husband to deliver up his passport or for an airport watch order to be put in place. The court found that the best interests of [X] were met by her living primarily with her mother and spending substantial and significant time with her father.
