CaseChat Overview and Summary
Samsonidis v Commissioner, Australian Federal Police was a case before the Full Court of the Federal Court of Australia. The plaintiff, Mr Samsonidis, was a former employee of the Australian Federal Police (AFP) who brought claims against the AFP and the Commissioner of the AFP for unlawful dismissal and breaches of the Racial Discrimination Act 1975. The primary judge found in favour of the AFP and the Commissioner, and Mr Samsonidis appealed to the Full Court.
The Full Court was required to decide whether the primary judge was correct in finding that Mr Samsonidis was not unlawfully dismissed and that there was no contravention of the Racial Discrimination Act. The court had to consider the evidence and arguments presented by both parties regarding the circumstances of Mr Samsonidis' dismissal and whether any racial discrimination occurred.
The Full Court found that the primary judge correctly applied the law and properly assessed the evidence in coming to the conclusion that Mr Samsonidis was not unlawfully dismissed. The court also found that there was no evidence to support Mr Samsonidis' claim that his dismissal was racially motivated. The Full Court held that the primary judge's findings were supported by the evidence and that there was no error in the decision. As a result, the appeal was dismissed and there was no order as to costs.
