Sampey and Sampey and Ors

In the matter of *Sampey and Sampey*, Rees J of the Family Court of Australia considered an application concerning spousal maintenance and the use of a motor vehicle. The dispute involved the financial obligations of the husband towards the wife pending further orders.

The court was required to determine the quantum and terms of interim spousal maintenance to be paid by the husband to the wife. Additionally, the court needed to make orders regarding the provision and ongoing lease payments for a specific German motor vehicle for the wife's sole use.

Rees J ordered that the husband pay a total of $1,409 per week by way of spousal maintenance, in addition to covering the costs of the wife's mobile phone usage up to $100 per month and $150 per month towards her Commonwealth Bank visa card. The first payment was to be made on 18 December 2014, with subsequent payments to be made weekly. The husband was also ordered to forthwith deliver a specified German motor vehicle to the wife for her sole use and to ensure that all lease payments for that vehicle were made as and when they fell due. The application was adjourned to a later date before Justice Stevenson.
