Salmon and Howard (No 2)

In *Salmon and Howard (No 2)*, the wife sought costs against the husband in relation to a subpoena issued to Professor M. The husband also sought an extension of time to file a case summary. The matter came before Macmillan J.

The primary legal issue before the court was whether the wife should be awarded her costs in relation to the subpoena issued to Professor M. A secondary issue was whether the husband should be granted an extension of time to file his case summary.

Macmillan J ordered that the wife pay the husband's costs relating to the subpoena to Professor M, fixed at $704.00, to be paid from the wife's property settlement. The court also extended the husband's time to file a case summary, pursuant to earlier orders, to 12:00 pm on 10 May 2013.
