CaseChat Overview and Summary
The Fair Work Commission considered the evidence and submissions presented by both parties, examining the process by which the agreement was negotiated and the nature of the terms it contained. In particular, the Commission looked at whether the agreement contained provisions that were no less favourable than the applicable award or safety net. The Commission found that the agreement had been made genuinely and fairly, with no evidence of coercion or undue influence. It also concluded that the agreement provided for fair and reasonable terms and conditions of employment, and met the criteria for being a “safety net” agreement. Therefore, the Commission approved the enterprise agreement.
As a result of the Commission's decision, the Salamanca Arts Centre Enterprise Agreement (2016-2018) was approved and registered. This meant that the agreement would be legally binding on both the employer and the employees, and would govern their employment terms and conditions for the duration of the agreement. The decision provided certainty and stability for both parties, and ensured that the agreement met the requirements of the Fair Work Act 2009.
