The Court held that the AAT's conclusion that Mr Saeed was not a genuine temporary entrant was not open to it on the evidence before it, and that the AAT had therefore made an error of law.
The Court ordered that the AAT's decision be set aside and remitted to the AAT for redetermination according to law.
