The Administrative Appeals Tribunal considered an application for a Visitor (Class FA) visa, Subclass 600 (Sponsored Family stream), made by a 31-year-old man from Minieh, Lebanon. The Tribunal reasoned that while general country information indicated a volatile and unpredictable political and security situation in Lebanon, potentially discouraging return, the applicant's individual circumstances strongly supported his intention to return. These circumstances included stable employment since 2014, a comfortable financial position, a history of compliant travel to and from Australia and other countries, and close family ties in Lebanon. Furthermore, the Tribunal noted the applicant's sponsor's willingness to provide financial security and her awareness of the consequences of non-compliance, which served as an additional incentive for the applicant to adhere to visa conditions. On balance, the Tribunal concluded that the factors favouring compliance and timely return outweighed speculative factors suggesting non-compliance.

Consequently, the Tribunal remitted the application for reconsideration with a direction that the visa applicant meets the criteria for the visa, specifically clause 600.211.
