CaseChat Overview and Summary

The applicant, Todd Patrick Richard Ryan, was convicted on 13 counts of dishonestly obtaining a financial advantage from a Commonwealth entity by deception and two counts of attempting to do so. He was sentenced to six years imprisonment with a non-parole period of three years and six months. Following his release on parole, the applicant filed notices of appeal against his convictions and sentence. The Court of Appeal of South Australia was required to consider an application by the applicant to withdraw a notice of discontinuance he had previously filed in respect of his appeal against conviction.

The central legal issue before the Court was whether the applicant should be permitted to withdraw his discontinuance of his appeal against conviction, thereby reinstating that appeal. This required the Court to assess the applicant's explanations for the delay in seeking to withdraw the discontinuance and to determine whether it was in the interests of justice to grant the application. The Court also considered whether the applicant had made a deliberate and informed decision to discontinue his appeal against conviction.

The Court found that the applicant had been represented by experienced legal practitioners throughout the relevant period and had received clear advice regarding the consequences of discontinuing his conviction appeal. The evidence indicated that the applicant made a strategic decision to discontinue his conviction appeal in favour of pursuing his sentence appeal, believing this would lead to a more prompt outcome. The Court was not satisfied with the applicant's explanations for the delay in seeking to withdraw the discontinuance, finding them to be unsatisfactory. The Court concluded that it was not in the interests of justice to permit the withdrawal of the discontinuance.

Consequently, the Court refused the applicant leave to withdraw his notice of discontinuance. The Court also indicated that it would have refused an extension of time to file a notice of appeal against conviction in the terms proposed by the applicant.
