CaseChat Overview and Summary

Royal Brunei Airlines Sdn Bhd, the applicant, sought approval of the Enterprise Agreement 2013. The respondent, Australian Services Union, National Office, opposed the application, arguing that the agreement did not meet the criteria for approval under the Fair Work Act 2009. The Fair Work Commission heard the matter and was required to decide whether the agreement met the requirements for approval under the Act.

The key issue before the Commission was whether the agreement provided for fair and reasonable terms of employment. The respondent argued that the agreement did not provide adequate protections for employees' working conditions and entitlements. The Commission examined the agreement in detail and considered submissions from both parties. The Commission found that the agreement met the requirements for approval and did provide for fair and reasonable terms of employment.

The Commission noted that the agreement provided for a range of protections for employees, including minimum rates of pay, leave entitlements, and provisions for redundancy and termination of employment. The Commission also found that the agreement provided for mechanisms for resolving disputes between the employer and employees, which was an important factor in determining whether the agreement met the requirements for approval. The Commission rejected the respondent's arguments that the agreement did not provide adequate protections for employees' working conditions and entitlements. The Commission approved the agreement, finding that it met the requirements for approval under the Act.

The Commission's decision was based on a detailed analysis of the agreement and the submissions made by both parties. The Commission found that the agreement provided for fair and reasonable terms of employment and that it met the requirements for approval under the Fair Work Act 2009. The respondent's application for approval of the agreement was dismissed.
