CaseChat Overview and Summary

The parties involved in the case were the Royal Agricultural & Horticultural Society of SA Inc, trading as the Adelaide Event & Exhibition Centre, and its employees, represented by the Shop, Distributive & Allied Employees Association (SDA). The dispute centred around the application for approval of the Adelaide Event & Exhibition Centre Operations Personnel Enterprise Agreement 2015. The matter was heard in the Fair Work Commission.

The legal issues before the Commission were whether the application for approval of the enterprise agreement met the necessary criteria for approval under the Fair Work Act 2009. Specifically, the Commission had to determine whether the agreement was "certified" and whether it met the "better off overall test." This test required the Commission to consider whether the proposed agreement would provide employees with a better overall outcome than the existing industrial instrument.

The Fair Work Commission found that the application for approval of the enterprise agreement met the necessary criteria. The Commission certified the agreement, finding that it was in the public interest and met the better off overall test. The Commission considered the evidence presented by both parties and concluded that the agreement provided employees with improved wages, conditions, and job security. The Commission also noted that the agreement included provisions for the resolution of workplace disputes, which was in the interests of maintaining a harmonious workplace.

The Fair Work Commission approved the Adelaide Event & Exhibition Centre Operations Personnel Enterprise Agreement 2015. The agreement now provides the terms and conditions of employment for the employees of the Adelaide Event & Exhibition Centre. The Commission's decision provides certainty for both the employer and employees and ensures that the agreement is fair and reasonable.
