Rothcote Pty Ltd v Council of the Shire of Pine Rivers

The case of Rothcote Pty Ltd v Council of the Shire of Pine Rivers involved a dispute over compensation for the resumption of land for road and environmental purposes. The Court had to determine the value of the land before and after the resumptions, and whether any compensation was payable under the Acquisition of Land Act 1967. The primary issue was whether the development potential of the land, before the road resumption, was to be considered strictly in terms of the Development Control Plan (DCP), or whether certain development conditions and restrictions imposed by the DCP were to be ignored. The Court found that the scheme underlying the resumption for road purposes was the proposal to construct a distributor road, and that the highest and best use of the land, before the resumption, was its existing use. After the road resumption, the highest and best use of the land was for residential subdivision. The Court held that significant enhancement resulted from the resumption, and no compensation was payable for the road resumption. For the environmental resumption, the Court awarded compensation of $197,250. The Council was ordered to pay interest on the compensation amount at the rate of 7% per annum from 6 September 1996 until payment of compensation. No costs were awarded to either party.
