The Court further held that EnergyAustralia, as the successor to the Sydney County Council, had inherited this lawful authority to maintain the pole. Regarding the alleged contract for removal, the Court concluded, on the facts, that no such contract had been made.

Consequently, the appeal was dismissed, and the appellant was ordered to pay the respondent's costs.
