Rose and Rose

In *Rose and Rose*, Murphy J of the Family Court of Australia determined the property settlement between the Husband and Wife. The dispute concerned the division of their respective assets and liabilities.

The central legal issue before the court was how to equitably distribute the property of the parties. This involved considering all financial resources, real and personal property, and liabilities held by each party.

Murphy J ordered that each party retain sole entitlement to all interests in realty, chattels, cash at bank, financial resources, shares, superannuation, and liabilities presently in their respective names, possession, or control. The court further ordered the return of all subpoenaed documents and exhibits to their original custodians and tenderers, and that the matter be removed from the pending cases list. There was no order as to costs.
