The Tribunal noted that the expenditure of settlement funds on housing improvements, while understandable, did not create a situation of unavoidable hardship that would warrant overriding the legislative provisions regarding compensation preclusion periods.

Ultimately, the Tribunal affirmed the reviewable decision made on 6 November 2023. This meant that the cancellation of Mr Rofouzos's disability support pension was upheld, as he had not successfully demonstrated the existence of special circumstances that would allow for the waiver or write-off of the compensation charge debts.
