Rodriguez Buitrago (Migration)

The Administrative Appeals Tribunal considered an application for review concerning a Temporary Skill Shortage (Class GK) visa, subclass 482, short-term stream, for the occupation of Graphic Designer. The applicant, Ingrid Johanna Rodriguez Buitrago, was the subject of an approved nomination by Flesfadar Pty Ltd.

The primary legal issue before the Tribunal was whether the nomination lodged by Flesfadar Pty Ltd for Ms. Rodriguez Buitrago met the requirements of clause 482.212(1) of the Migration Regulations 1994. This clause mandates that the nomination must have been approved, made by an approved work sponsor at the time of approval, and not have ceased.

The Tribunal reasoned that Flesfadar Pty Ltd was approved as a standard business sponsor on 5 August 2021, a date prior to their nomination application for Ms. Rodriguez Buitrago on 21 October 2021. Although the initial nomination decision was refused, the Tribunal subsequently set aside that refusal and substituted it with a decision approving the nomination on 13 June 2024. Consequently, the Tribunal found that the requirements of clause 482.212(1) were satisfied.

Given these findings, the Tribunal remitted the application for the Temporary Skill Shortage (Class GK) visa for reconsideration by the Minister, with a direction that the applicant meets clause 482.212(1). The Minister is now to consider the remaining visa criteria.
