Olga Robinson has appealed against the annual valuation of her property, Lot 136 on RP 54571, Parish of Bulimba, at Norman Park, Brisbane. The Chief Executive of the Department of Natural Resources has issued a valuation of the property at $182,500 on 17 March 1997. Ms Robinson lodged an objection against the valuation on 11 April 1997, which was acknowledged by the Chief Executive on 16 April 1997. The Chief Executive issued a decision on the objection on 2 December 1997, reducing the valuation to $170,000. Ms Robinson sought an extension of time to lodge an appeal on 30 December 1997, but the Land Court refused to grant the extension. The appeal was eventually lodged on 14 January 1998. The issue before the Court was whether it had jurisdiction to hear the merits of the case in respect of the appeal against the annual valuation. The Court found that the statutory period for lodgment of the appeal had expired, and the reasons for the delay did not satisfy the provisions of the Valuation of Land Act 1944. The Court held that it had no power to extend the statutory period and dismissed the appeal for want of jurisdiction.

The Court found that the appellant's delay in lodging the appeal was not caused by undue delay in the transmission of mail, as required by the Act. The delay was caused by personal arrangements put in place by the appellant during her absence on holidays. The Court noted that the appellant had acted quickly once she became aware of the correct procedure, but the onus to lodge the appeal within the specified time was clearly upon her. The Court held that it was a body of statutory powers, and as such could only exercise such powers in accordance with the directions of the Legislation. The Court found that it had no jurisdiction to proceed with the appeal on its merits and struck out the appeal for want of jurisdiction.
