Robertson and Secretary, Department of Social Services (Social services second review)

This matter concerned a review of a decision by the Secretary of the Department of Social Services regarding a claim for Disability Support Pension (DSP) made by Mr. Robertson. The dispute centred on whether Mr. Robertson qualified for the DSP on the date he lodged his claim, or within the subsequent 13-week period, as stipulated by the Social Security (Administration) Act 1999. The review was heard by Mr. D.J. Morris, a Member of the Tribunal.

The primary legal issues before the Tribunal were twofold: firstly, whether Mr. Robertson was qualified for DSP on 13 July 2015, the date he lodged his claim; and secondly, if he was not qualified on that date, whether he became qualified within the 13-week period commencing 14 July 2015 and ending 13 October 2015, as defined by clause 4(1) of Schedule 2 of the Administration Act. This determination required the application of section 36(1) of the Acts Interpretation Act 1901, specifically item 5 of the table, which dictates that a period of time expressed to begin from a specified day does not include that day.

The Tribunal considered medical evidence from Mr. Robertson's general practitioner, Dr. Nola Maxfield, who detailed his conditions of lower back pain with radiation down his left leg and Follicular Grade 1 lymphoma. Dr. Maxfield indicated that the lower back pain caused daily pain, reduced endurance, and limited his ability to lift or be dextrous, with a constant need to change position. She also noted that the lymphoma impacted his endurance, physical activity tolerance, and concentration. Despite these conditions, the Tribunal found that Mr. Robertson was not qualified for DSP on the date of his claim, nor did he become qualified within the subsequent 13-week claim period.

Consequently, the Tribunal affirmed the original decision, finding that Mr. Robertson did not meet the eligibility criteria for the DSP within the relevant timeframe.
