CaseChat Overview and Summary

Roadlinez Pty Ltd, the employer, applied to the Fair Work Commission for approval of an enterprise agreement. The applicant, Roadlinez Pty Ltd, sought approval of the Roadlinez Pty Ltd Enterprise Agreement 2025. The applicant’s employees, represented by the Australian Manufacturing Workers Union, did not object to the application. The dispute before the Commission was whether the agreement met the requirements of the Fair Work Act 2009 (Cth) for a registered agreement to be approved.

The principal legal issues the Commission was required to determine were whether the agreement provided for the mandatory minimum terms and conditions set out in section 235 of the Fair Work Act 2009 (Cth), and whether the agreement complied with the good faith bargaining requirement in section 228 of the Fair Work Act 2009 (Cth). The Commission found that the agreement contained all the mandated minimum terms and conditions, and that it complied with the good faith bargaining requirement. The Commission approved the agreement, and made an order approving the agreement.
