The case involved an appeal against the decision of the District Court of the Australian Capital Territory (ACT). The appellant challenged the conviction for operating a light rail service without accreditation. The appellant argued that the offence was not applicable as they were operating a bus service, not a light rail service. The legal issue was whether the appellant's operation of a bus service fell within the definition of operating a light rail service under the Road Transport (Public Passenger Services) Act 2001 as amended by the Road Transport Reform (Light Rail) Legislation Amendment Act 2018 (ACT).

The court considered the definition of "light rail service" in section 27A(1) of the Act, which states that a light rail service is a public passenger service operated using light rail. The court held that the appellant's operation of a bus service did not constitute a light rail service as defined in the Act. Consequently, the offence of operating a public passenger service without accreditation under section 27B of the Act was not applicable to the appellant's bus service operation.

The court concluded that the appeal was well-founded and allowed the appeal, setting aside the conviction. The matter was remitted to the District Court for further consideration in light of the court's decision.
