The court also concluded that the appellants' conduct did not warrant a Bullock order requiring them to reimburse Pacific National for the RTA's costs.

Consequently, the appeal against Pacific National concerning Order 7 made by James J was allowed and that order was set aside, with the remainder of the appeal dismissed. The appeal against the RTA was dismissed with costs.
