Rickard and Rickard

In the matter of *Rickard and Rickard*, Foster J considered an application for interim spousal maintenance and a property settlement. The dispute concerned the financial support to be provided by the husband to the wife pending final resolution of their property settlement proceedings.

The court was required to determine the appropriate quantum and duration of interim spousal maintenance, as well as the immediate distribution of funds from a controlled money account to the wife. The court also needed to consider the characterisation of a portion of the funds to be paid to the wife, reserving this for final determination.

Foster J ordered the husband to pay the wife $1,000 per week for 50 weeks by way of interim spousal maintenance, with the first payment due within seven days. Additionally, the court directed that the wife be paid $50,000 from funds held in a controlled money account within seven days. A further $50,000 was also to be paid to the wife from the same account within seven days, with the characterisation of this payment reserved for the final hearing. The court also made directions for the filing and service of written submissions regarding costs.
