CaseChat Overview and Summary
The Fair Work Commission examined the process by which the agreement was reached, considering whether the parties had genuinely bargained and whether the agreement was made in good faith. Additionally, the Commission scrutinised the content of the agreement to ensure it included all mandatory terms as stipulated by the Fair Work Act. The Commission found that the agreement had been made in good faith and that the bargaining process was genuine. The agreement was also found to contain all mandatory terms required by the Act, leading to the conclusion that the agreement was compliant.
In light of its findings, the Fair Work Commission approved the Resthaven Incorporated Nursing Employees ANMF Enterprise Agreement 2013.
