This appeal was brought from orders made by Northrop J. in the Federal Court of Australia, which had dismissed an appeal from decisions of the Administrative Appeals Tribunal. Mavis Irene Stafford, the widow of William Arthur Stafford, was the applicant for review by the Tribunal of decisions of the Repatriation Commission that had been affirmed by the Veterans' Review Board. Mr. Stafford had died after the Tribunal had given its decision. The Repatriation Commission sought review of the Tribunal's decision by this court. The appeal raised questions as to the interpretation of provisions of the Veterans' Entitlement Act 1986 and as to the correctness of the Tribunal's exercise of its jurisdiction. The appeal was dismissed. The respondents costs of the appeal were ordered to be paid by the appellant. The Court found that the Tribunal had erred in law in concluding that it did not have jurisdiction to review the Commission's decisions concerning two of the claimed diseases, chronic obstructive airways disease and hypertension. The Court held that the application for review by the Board of the Commission's decision concerning Mr. Stafford's pension claim was not limited to the diseases of osteoarthritis of knees and hips and otitis externa, but rather that it included all determinations of the Commission as to whether conditions of entitlement had been satisfied. The Court held that the Tribunal was wrong in concluding that the claim concerning chronic obstructive airways disease and hypertension had been withdrawn from the Board's review. The Court held that the Tribunal's review of the Board's decision was required to include consideration of the decisions of the Commission concerning chronic obstructive airways disease and hypertension.
