CaseChat Overview and Summary
The legal issues before the Commission included whether the agreement met the procedural requirements for approval, whether it contained terms that were genuinely negotiated, and whether the agreement provided for the appropriate level of employee protection. The Commission also considered whether the agreement was likely to have a detrimental effect on the employees’ overall conditions and if the agreement was consistent with the principles of the Fair Work Act.
The Fair Work Commission determined that the application met the procedural requirements for approval and that the agreement was genuinely negotiated. The Commission found that the agreement provided adequate protections for employees, and while some terms were less favourable than the relevant award, the overall effect of the agreement was not detrimental to employees. The Commission took into account the unique circumstances of the industry and the necessity for flexibility in the agreement to enable the business to operate effectively.
As a result, the Fair Work Commission approved the Reoforce Contractors Pty Ltd Enterprise Agreement 2014-2017. The decision was made on the basis that the agreement was fairly negotiated, provided adequate protections for employees, and was not detrimental to their overall conditions.
