CaseChat Overview and Summary

This matter concerned an application for an Aged Parent (Residence) (Class BP) visa, subclass 804, by Mrs Benita Margaret Rensburg. The primary applicant, Mr Rensburg, had died, and the review application was for Mrs Rensburg, the secondary applicant. The central dispute revolved around whether Mrs Rensburg met Public Interest Criterion (PIC) 4005, which requires an applicant to be free from certain diseases or conditions that could result in significant costs to the Australian community through healthcare or community services. The Administrative Appeals Tribunal (AAT) considered the case.

The legal issues before the AAT were whether Mrs Rensburg was free from tuberculosis, a threat to public health or danger to the Australian community, or a condition likely to require healthcare or community services resulting in significant cost to the Australian community or prejudicing access for Australian citizens or permanent residents. The AAT was required to determine if a Medical Officer of the Commonwealth (MOC) opinion was necessary and, if so, to treat that opinion as correct, provided the MOC had applied the correct legal test.

The AAT noted that Mrs Rensburg had a "mild functional impairment." As she was applying for a permanent visa, the exclusion provisions for temporary visas did not apply. The Tribunal found that a MOC opinion was required and that, based on the evidence, Mrs Rensburg did not meet the criteria for the visa. The Tribunal recommended the matter be referred to the Minister for consideration under s.351 of the Migration Act 1958 (Cth).

The application by Mrs Benita Margaret Rensburg was withdrawn. The Tribunal affirmed the decision not to grant the applicant an Aged Parent (Residence) (Class BP) visa.
