CaseChat Overview and Summary

This matter concerned an appeal by Ms Reid against a decision by Comcare regarding her claim for compensation for major depression. The dispute centred on whether Ms Reid's condition arose out of, or in the course of, her employment, and whether workplace stressors were a significant contributing factor. The case was heard by Deputy President Bernard McCabe.

The court was required to determine whether Ms Reid's major depression was an injury for the purposes of the *Safety Rehabilitation and Compensation Act 1988* (Cth). Specifically, the court had to assess whether the workplace stressors, including overwork and conflict, contributed to her condition to a degree that was "substantially more than material." The court also considered other potential stressors, such as the breakdown of a personal relationship and her mother's health, to ascertain their relevance and contribution to the diagnosed condition.

Deputy President McCabe found that the applicant's treating psychiatrist, Dr Holm, confirmed that Ms Reid likely experienced major depression, with symptoms potentially predating her transfer to Brisbane in mid-2011, but reaching a severity warranting diagnosis by July 2012. Dr Holm considered workplace conflict and stress from overwork to be sufficient to precipitate the onset of major depression, acknowledging that while depression is often multi-factorial, the workplace stressors were a significant cause. The court accepted Dr Holm's evidence that a personal relationship breakdown in August 2010 was not a significant factor, as Ms Reid did not consider it serious and did not seek medical assistance. The court also noted that while her mother's health was a source of stress, the workplace factors were deemed to have contributed "substantially more than material" to the condition. Consequently, the decision under review was set aside, and Comcare was found liable for Ms Reid's major depression condition pursuant to section 14 of the Act.
