CaseChat Overview and Summary
The central legal issue before the commission was whether the proposed enterprise agreement complied with the requirements of the Fair Work Act 2009. Specifically, the union argued that certain provisions regarding shift patterns and penalty rates did not meet the "better off overall test," which ensures that employees are not worse off financially under the new agreement. The union also contended that the agreement did not adequately address issues of redundancy and the transition of employees to the new conditions.
In determining the application, the commission considered the evidence presented by both parties and examined the provisions of the agreement against the statutory framework. The commission found that the proposed agreement met the better off overall test, as the overall financial benefits to employees outweighed any disadvantages. The commission also concluded that the agreement contained adequate provisions for redundancy and transition, thus addressing the union's concerns. Consequently, the commission approved the enterprise agreement.
The final orders of the commission were that the Bulla Dairy Foods Colac Operations Enterprise Agreement 2017-2020 be approved as a registered agreement under the Fair Work Act 2009. The agreement is to be registered with the Fair Work Commission and will apply to the employees at the Colac site from the specified commencement date.
