CaseChat Overview and Summary
This case concerns an application for a mining lease by Ian Earl Wallace for land located 4.5 km north north-west of Irvinebank, under section 245 of the Mineral Resources Act 1989. The application sought the grant of a mining lease for a period of 18 years to mine for gold, building stone, garnet, foundry sand, and tin ore. The application was lodged on 12 June 2003, and no objections were lodged by the deadline of 8 September 2009. The applicant requested that the application be heard on the papers, and the Judicial Registrar agreed to dispense with a hearing.
The court had to consider whether the application complied with the provisions of the Mineral Resources Act 1989 and whether the land was mineralised and the other purposes for which the lease was sought were appropriate. The court also had to assess whether the applicant had the necessary financial and technical capabilities to carry out the proposed mining operations, and whether the operations conformed to sound land use management. Additionally, the court had to determine if the proposed mining operation was an appropriate land use, taking into consideration the current and prospective uses of the land.
The Judicial Registrar was satisfied that the provisions of the Act had been complied with, the land was mineralised, and the purposes for which the lease was sought were appropriate. The Registrar also found that the applicant had the necessary financial and technical capabilities to carry out the proposed mining operations, and that the operations conformed to sound land use management. The Registrar further determined that the proposed mining operation was an appropriate land use, taking into consideration the current and prospective uses of the land. Based on these findings, the Registrar recommended to the Honourable the Minister for Mines and Energy that the Mining Lease be granted over the whole of the application area for the purpose and term sought by the applicant.
The Judicial Registrar recommended that the Honourable the Minister for Mines and Energy grant Mining Lease No. 20391 over the whole of the application area for a term of 18 years, subject to the conditions of the draft environmental authority issued. The Registrar also ordered that a hearing of this application be dispensed with.
