Re State Public Services Federation; Ex parte The State of Victoria

The State of Victoria sought writs of prohibition and certiorari against the Honourable Joseph Martin Riordan, a Senior Deputy President of the Australian Industrial Relations Commission, and the State Public Services Federation of Australia. The application concerned an order made by the Senior Deputy President.

The central legal issue before the High Court was whether the orders nisi, which had been made on 8 March 1993 by Justice McHugh, should be discharged.

By consent of the parties, as certified by the Deputy Registrar, the High Court made an order discharging the orders nisi. The matter was subsequently adjourned sine die.
