After carefully reviewing the evidence, the court found that the sales presented by Mr Evans were not overly blighted and were relevant for comparison purposes despite their need for fill. The court noted that Mr Evans’ approach of adjusting the sales for fill was unnecessary as the subject land did not require such adjustments. The court concluded that the fair unimproved value of the subject land, taking into account its advantages and disabilities, was $42,500. This value was considered a fair reflection of the land’s worth as at the relevant date of 1 July 1996.
The court determined the unimproved value of NCL 44/838, Townsville District, for the purpose of conversion of tenure to be $42,500. This decision was based on a balanced consideration of the comparative sales evidence and the specific circumstances of the subject land, including its flooding issues and the market conditions at the relevant time.
