CaseChat Overview and Summary

The Land Court of Queensland dealt with an application for a mining lease by Kevin James Porter, Daniel William Burnes, and Graham Leslie Ratcliffe. The applicants sought a mining lease over land approximately 500 meters south-west of Yowah for opal mining and stockpile for ore/overburden for a term of 10 years. The application was made under section 245 of the Mineral Resources Act 1989. The application was lodged on 25 May 2008, and no objections were lodged before the closing date of 8 October 2008. The court was required to decide whether the application met the statutory criteria set out in section 269(4) of the Act, including whether the land was mineralised, the term sought was appropriate, and the proposed mining operation would not result in adverse environmental impacts or prejudice public rights.

The court found that the applicants had complied with the provisions of the Act and that the area was generally mineralised with a history of opal production. The applicants proposed to use common machinery and practices in the area, which suggested an acceptable level of development and utilisation of the mineral resources. The size and shape of the lease area were determined by the area of potential mineralisation, and the applicants had the necessary financial and technical capabilities to undertake the proposed operations. No evidence suggested any adverse environmental impacts, public rights would be prejudiced, or that the proposed mining operation was not an appropriate land use. The court concluded that all criteria were satisfied and recommended the grant of the mining lease.

The Judicial Registrar, Mr. BR O’Connor, recommended to the Minister for Mines and Energy that Mining Lease No. 60445 be granted to the applicants over the whole of the application area for a term of 10 years. The court also ordered that a hearing of this application be dispensed with, as the material provided was sufficient to properly consider the matter. The final orders included recommending the grant of the mining lease and dispensing with the hearing.
