Re Opalton Mines Qld Pty Ltd [2007] QLC 103 [2007] QLC 103 2 November 2007

CaseChat Overview and Summary

Opalton Mines Qld Pty Ltd applied for a mining lease under s. 245 of the Mineral Resources Act 1989 (the Act) to mine opal over 13.0556ha of land in the Opalton area. No objections were lodged against the application. The matter was heard on the papers by Windridge J. The court had to decide whether to dispense with a hearing and whether to recommend the grant of the mining lease. Windridge J considered the criteria specified in s. 269(4) of the Act, including compliance with the Act, the appropriateness of the land and term sought, and the environmental and public interest impacts. The applicant had complied with the Act, the land was mineralised and of an appropriate size and shape, and the applicant had the financial and technical capability to mine the area. The proposed mining operation was in accordance with sound land use management and would not adversely impact the environment or public rights. There was no evidence to suggest any good reason for refusal. Windridge J recommended that the mining lease be granted over the whole of the application area for the purpose and term sought by the applicants.

The court recommended that the mining lease be granted as the applicant had satisfied the criteria under s. 269(4) of the Act. The applicant complied with the Act, the land was mineralised and of an appropriate size and shape, and the applicant had the financial and technical capability to mine the area. The proposed mining operation was in accordance with sound land use management and would not adversely impact the environment or public rights. Windridge J took into account the absence of objections and the applicant's satisfactory past performance. The court concluded that there was no good reason to refuse the application and that the proposed mining operation was an appropriate land use. The final order was to recommend to the Minister for Mines and Energy that the mining lease be granted over the whole of the application area for the purpose and term sought by the applicants.
