Re Lunney

In the Land Court of Queensland, Edward Lawrence Lunney filed an application under Section 245 of the Mineral Resources Act 1989 for a mining lease on land approximately 60 kilometres northwest of Quilpie. The purpose of the lease was to mine opal and establish a stockpile and living quarters for a period of three years. The application was lodged on 11 June 2008, and no objections were raised before the deadline of 6 November 2008. The applicant requested that the matter be dealt with on the papers by a member sitting alone. The primary legal issue before the court was whether the application met the criteria for granting a mining lease as outlined in Section 269(4) of the Act.

The court considered several factors to determine if the application complied with the Act, including whether the applicant had the necessary financial and technical capabilities, if the land was mineralised, and if the proposed term was appropriate. The court found that the applicant had complied with the Act's requirements and that the land was generally mineralised and suitable for opal mining. The court also determined that the proposed term of three years was appropriate and that the applicant had the necessary financial and technical resources to undertake the proposed operation. Additionally, the court found that the proposed mining operation conformed to sound land use management and would not adversely affect existing exploration permits or mineral development licences.

Based on the evidence presented and the criteria outlined in Section 269(4) of the Act, the court recommended to the Honourable the Minister for Mines and Energy that Mining Lease No. 60447 be granted over the whole of the application area for the purpose and term sought by the applicant. The court also ordered that a hearing of this application be dispensed with, as requested by the applicant.
