Re Lousick and Edwards [2009] QLC 170 [2009] QLC 170 19 November 2009

CaseChat Overview and Summary

The Land Court of Queensland was presented with an application for a mining lease by Ronald William Lousick and Raymond Edward Edwards under section 245 of the Mineral Resources Act 1989. The applicants sought a mining lease over land located 180 km north-west of Chillagoe, primarily for the extraction of gold, garnet, and rare earth minerals, for a period of five years. The application was made on 11 August 2003, and no objections were lodged by the closing date of 12 October 2009. The applicants requested that the matter be dealt with on the papers, and the Judicial Registrar, Mr. BR O’Connor, granted this request.

The primary legal issues for the court to decide included whether the provisions of the Mineral Resources Act 1989 had been complied with, whether the land was mineralised or if the proposed purposes for the lease were appropriate, and if the applicants had the necessary financial and technical capabilities to undertake the proposed mining operations. Additionally, the court needed to consider if the proposed mining operations would result in any adverse environmental impacts or prejudice public rights and interests.

Mr. BR O’Connor, Judicial Registrar, found that the application complied with the requirements of the Mineral Resources Act 1989, as evidenced by the Certificate of Application issued by the Registrar. The land in question was deemed to be mineralised, given the historical production of the sought minerals in the area. The proposed mining methods and equipment were considered appropriate, and there was no evidence suggesting that the applicants lacked the necessary financial and technical capabilities. The Registrar also determined that the proposed mining operations would not adversely impact the environment, public rights, or interests, and that the term of the lease was appropriate. Consequently, the Judicial Registrar recommended to the Honourable the Minister for Mines and Energy that the mining lease be granted over the whole of the application area for the purpose and term sought by the applicants.

The Judicial Registrar's recommendation was that Mining Lease No. 20400 be granted over the whole of the application area for a term of 5 years to Ronald William Lousick (50%) and Raymond Edward Edwards (50%). The Registrar also ordered that a hearing of the application be dispensed with, as the matter was appropriately dealt with on the papers.
