Re Lousick & Edwards

Ronald William Lousick and Raymond Edward Edwards applied for a mining lease over a specified area located 180 km north-west of Chillagoe, for the purpose of mining for gold, garnet, and rare earths. The application was submitted under section 245 of the Mineral Resources Act 1989 and was considered by the Land Court of Queensland. The applicants sought a mining lease for a term of 10 years, and no objections were lodged within the stipulated timeframe.

The court had to determine whether the application met the criteria specified in section 269(4) of the Act. This included verifying if the provisions of the Act had been complied with, whether the land was mineralised or if the proposed purposes for the lease were appropriate, and if the applicants had the necessary financial and technical capabilities to undertake the proposed operations. Based on these findings, the court recommended to the Minister for Mines and Energy that the Mining Lease No. 20548 be granted over the whole of the application area for the purpose and term sought by the applicants.

The court ordered that a hearing be dispensed with and recommended to the Minister for Mines and Energy that Mining Lease No. 20548 be granted over the whole of the application area for a term of 10 years, with Ronald William Lousick and Raymond Edward Edwards holding equal shares in the lease.
